• "Services" refers to the residence accommodations, support, and related services provided by golde oik.
• "Residence Agreement" refers to the specific contract entered into between golde oik and a resident or their authorized representative.
• "Website" refers to our online presence and any associated web pages or platforms operated by golde oik.

2. Acceptance of Terms

By accessing our website or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with these terms, you should not use our website or services.

These terms apply to all users of our website and services. For residents entering into a Residence Agreement, additional specific terms will apply as outlined in that agreement. In case of any conflict between these general terms and a Residence Agreement, the Residence Agreement will take precedence regarding residence-specific matters.

You must be at least 18 years of age to enter into binding agreements with us. By using our services, you confirm that you have the legal capacity to do so or are acting with proper authorization on behalf of someone who will be a resident.

3. Service Description

golde oik provides senior living arrangements through three residence levels: Compass Point, Navigator, and North Star. Each level offers different combinations of accommodations and support services as detailed on our website and in our Residence Agreements.

Our services are designed to provide comfortable living arrangements and appropriate support for senior adults. We do not provide medical services or skilled nursing care. Residents requiring medical treatment should consult with their own healthcare providers, and we will coordinate with healthcare professionals as appropriate.

Service availability and specific features may vary based on the chosen residence level, individual circumstances, and facility capacity. We reserve the right to modify service offerings with appropriate notice to residents and families.

4. User Responsibilities

Accurate Information

You agree to provide accurate, current, and complete information when communicating with us, submitting inquiry forms, or entering into agreements. You are responsible for updating information as circumstances change to ensure we can provide appropriate services.

Appropriate Use

Users agree to use our website and services in a lawful manner that respects the rights and dignity of others. Prohibited activities include providing false information, attempting to disrupt services, engaging in harassment, or using our facilities or services for any unlawful purpose.

Resident and Family Conduct

Residents and their families are expected to treat staff members and other residents with respect. We maintain policies regarding appropriate conduct within our facility, and violations of these policies may result in termination of the Residence Agreement under the terms specified in that agreement.

5. Payment Terms

Fees and Pricing

Monthly residence fees are specified for each residence level and are detailed in individual Residence Agreements. Fees are payable in Malaysian Ringgit (RM) and are due according to the payment schedule outlined in your agreement, typically on a monthly basis in advance.

Fee Adjustments

We reserve the right to adjust residence fees with reasonable notice, typically provided at least 60 days in advance. Fee adjustments may reflect changes in operating costs, service enhancements, or market conditions. Current residents will be notified in writing of any fee changes.

Late Payments

Late payment fees may apply to overdue balances as specified in your Residence Agreement. Consistent non-payment may result in termination of services according to the procedures outlined in your agreement and applicable law.

Refund Policy

Refund terms are specified in individual Residence Agreements and depend on the circumstances of termination, notice periods provided, and services already rendered. Deposits and advance payments are handled according to the terms of your specific agreement.

6. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of golde oik or our licensors and is protected by Malaysian and international intellectual property laws. You may view and use website content for personal, non-commercial purposes only.

You may not reproduce, distribute, modify, or create derivative works from our website content without explicit written permission. This restriction does not apply to content you create yourself, such as reviews or feedback, which you grant us permission to use as outlined in our Privacy Policy.

The golde oik name and logo are trademarks of our organization. Unauthorized use of these marks is prohibited and may violate trademark law.

golde oik does not provide medical services, medical advice, or healthcare treatment. While our staff may assist with coordinating appointments and transportation for medical care, residents and their families are responsible for maintaining relationships with appropriate healthcare providers.

8. Limitation of Liability

Our total liability for any claims arising from our services shall not exceed the amount of fees paid by you during the three months preceding the event giving rise to the liability.

9. Indemnification

10. Termination

Termination by Either Party

Either party may terminate a Residence Agreement according to the notice periods and procedures specified in that agreement. Termination procedures respect the rights of both residents and the facility while ensuring orderly transitions.

Effects of Termination

Upon termination, residents or their representatives are responsible for removing personal belongings within the timeframe specified in the Residence Agreement. Financial obligations through the effective termination date remain in effect.

Survival of Terms

Provisions regarding payment obligations, confidentiality, intellectual property, limitations of liability, and dispute resolution survive termination of the agreement.

11. Dispute Resolution

Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these terms or our services will be subject to the jurisdiction of the courts of Malaysia, specifically those with jurisdiction in Kuala Lumpur.

Informal Resolution

Waiver

Assignment

You may not assign or transfer your rights or obligations under these terms without our written consent. We may assign our rights and obligations to any successor or affiliated entity.
